Congressional Bill Would Recognize Unborn Babies as Legal “Persons” Entitled to Equal Protection

A new U.S. Congressional bill calls on lawmakers and the U.S. Supreme Court to restore legal protections to unborn babies nationwide through the 14th Amendment.

On Monday, U.S. Reps. Doug Lamborn, R-Colorado, and Debbie Lesko, R-Arizona, introduced the Recognizing Life Resolution (House Resolution 464) to acknowledge “that unborn children are legal and constitutional persons who are entitled to the equal protection of the laws,” Colorado Springs Indy reports.

“While we are grateful that Roe has been overturned, there is still much work to be done to advance and strengthen the protection of human life, beginning in the womb,” Lamborn said in a statement.

The bill, which has 20 co-sponsors, says every human life should be protected under the Equal Protection Clause of the 14th Amendment. The constitutional amendment guarantees “due process of law” and “the equal protection of the laws” to “any person,” and prohibits the government from depriving “any person, whoever he may be, of life, liberty and property without due process,” according to the bill.

The resolution urges U.S. Congress to enact laws that ensure unborn babies are included in these protections and calls on the Supreme Court to “acknowledge and vindicate the right of unborn children to the enjoyment of the equal protection of the laws in every state and federal territory.”

Additionally, it acknowledges that mothers often are second victims of the profit-driven abortion industry and abortionists alone should be punished for killing unborn babies. Protections for unborn babies “shall not be construed to permit the prosecution of any woman for the death of her unborn child,” the bill states.

Most states protected unborn babies from abortion prior to Roe v. Wade. In 1973, however, the ruling forced states to allow abortions for any reason up to viability, and more than 64 million unborn babies were aborted.

On June 24, 2022, the high court overturned the infamous ruling in Dobbs v. Jackson. Now, 15 states protect unborn babies by banning all or most abortions, and others are fighting in court to do the same. Research from Susan B. Anthony Pro-Life America estimates roughly 60,000 unborn babies have been saved from abortion so far.

But abortion remains legal in more than half of the states, and pro-life advocates want unborn babies to be protected everywhere in the U.S.

Right now, Congress does not have enough votes to pass an elective abortion ban nationwide. Pro-abortion Democrats control the U.S. Senate and some Republicans who claim to be pro-life also have criticized laws protecting unborn babies.

Meanwhile, polls consistently show a strong majority of Americans support strict limits on abortion, including parental consent for minors and bans on elective abortions after the first trimester and taxpayer funding for abortions. However, many still support killing unborn babies early in pregnancy and in cases of rape or incest.
