A Georgia judge has struck down the state’s Living Infants and Fairness Equality (LIFE) Act, which banned abortion after six weeks.
Georgia news outlet Wabe reports that Fulton Superior Judge Robert McBurney ruled the legislation is unconstitutional and doctors can perform abortions until approximately 22 weeks.
Kara Murray, the communications director for Georgia’s Attorney General Chris Carr, stated that Carr will appeal the decision.
“We believe Georgia’s LIFE Act is fully constitutional, and we will immediately appeal the lower court’s decision,” Murray wrote in a statement.
According to the American Civil Liberties Union, the ruling comes after the Georgia Supreme Court’s ruling that the LIFE Act was not void, even though it was created in 2019 when Roe v. Wade was still in place and thus seemingly opposed to federal law.
The Court allowed the law to stay in place since Roe v. Wade was overturned, and returned it to the lower court, which was responsible for deliberating whether the LIFE act violated “rights to privacy and equal protection.”

Wabe reports that Garrison Douglas, a spokesperson for Gov. Brian Kemp, wrote in a statement, “Once again, the will of Georgians and their representatives have been overruled by the personal beliefs of one judge. Protecting the lives of the most vulnerable among us is one of our most sacred responsibilities.”
In 2022, two women, Candi Miller and Amber Thurman, died in Georgia after botched chemical abortions. Although pro-abortion activists, including Vice President Kamala Harris, said the deaths are a result of the LIFE Act, pro-life OB/ GYN Dr. Christina Francis explained that abortion itself led to the deaths, not laws restricting abortion.
As CatholicVote previously reported, Francis, who is the head of the American Association of Pro-Life OB/GYNs (AAPLOG), stated in a video posted to her X account: “Madam Vice President: Stop lying to my patients! Your lies are harming women and they’re harming physicians!”
Francis continued in another video that Georgia’s LIFE Act makes it “very clear in that doctors can intervene in cases where women are facing potentially life-threatening complications of their pregnancy, or even if they have a chronic medical condition that poses a severe threat to their life or physical health.”
She concluded,
Candi and Amber, who we heard about yesterday, both suffered severe complications from abortion drugs that potentially led to their death. It’s important for women to understand that these drugs carry inherent risks and the way they’re being dispensed online now, because of the FDA’s reckless actions in removing medical supervision, is especially dangerous. It’s time for these lies to stop. Stop putting a political agenda ahead of women’s health!
